Property litigation rarely turns on novel legal questions. It turns on title, possession and the quality of documentation available to establish both.
A clear chain of title, mutation entries consistent with that chain, and evidence of settled possession will usually determine the outcome long before argument begins.
Parties are well advised to preserve original instruments, tax receipts and correspondence, and to act promptly when an adverse entry or third-party claim first appears.
